Apps and purchases
Our apps are distributed through the Apple App Store, and your use of them is also subject to Apple’s terms and the App Store’s rules. Any purchase, including a one-time in-app purchase to unlock features, is processed by Apple, not by us. We never receive or store your payment details. Refunds, billing, and related questions are handled by Apple under its policies.
Intellectual property
The Services, including their games, code, artwork, text, logos, and design, are owned by Hawaiian Shirt Studios or our licensors and are protected by intellectual property laws. These Terms don’t transfer any ownership to you. Our names, logos, and brand features may not be used without our prior written permission. Names and logos of third parties (such as Apple) belong to their respective owners.
Third-party services and links
The Services rely on and may link to third-party services (for example, Apple’s App Store and iCloud, GitHub, and our social media pages). We don’t control those services and aren’t responsible for their content, policies, or practices. Your use of them is governed by their own terms.
Availability and changes
The Services are provided on an ongoing but not guaranteed basis. We may add, change, suspend, or discontinue any part of the Services at any time, and we may update these Terms from time to time. When we make material changes, we’ll revise the “Last updated” date above. Your continued use of the Services after changes take effect means you accept the updated Terms.
Disclaimers
The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected.
Limitation of liability
To the fullest extent permitted by law, Hawaiian Shirt Studios will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Services. To the extent we are found liable, our total liability will not exceed the greater of the amount you paid us for the relevant Service or twenty U.S. dollars (US$20).
